Abstract

[ES] Se analiza cuál ha sido la recepción de Gadamer en el pensamiento jurídico. La tesis que se mantiene es que la hermenéutica de Gadamer se ha usado sobre todo para defender una ontología jurídica que ve el derecho como un objeto en permanente constitución y haciéndose en el proceso de su interpretación y aplicación. Sin embargo, la filosofía de Gadamer no aporta soluciones para el problema central de la teoría de la interpretación en el derecho, que es el problema de la racionalidad de la actuación judicial. Se ejemplifica todo esto mediante la referencia a autores como Arthur Kaufmann y Josef Esser.

[EN] This paper investigates the reception that Gadamer has received in the field of legal thinking. The view put forward is that Gadamer's hermeneutics have been used above all to defend a juridical ontology that sees law as an object that is constantly being created or made through the processes of interpretation and application. However, Gadamer's philosophy offers no solutions for the central problem in the theory of interpretation in law, which is the problem of rationality in judicial actions. These points are exemplified through references to scholars such as Arthur Kaufmann and Josef Esser.
