La dimensión territorial del Consejo Real en tiempo de Felipe III: el cuerpo de los Treinta Jueces

Abstract

[ES] Generalmente, la administración hispana en tiempo de Felipe III se ha considerado como una expresión más de un estado general de decadencia. Tal interpretación es común a testigos de la época e historiadores del presente. Sin embargo, creemos que esta idea admite revisión, porque no es coherente con la evidente institucionalización que venía viviendo la monarquía hispana desde la década de 1580, y de la que constituye ejemplo fundamental el Consejo Real. En tiempo de Felipe III se encontraron fórmulas idóneas para afrontar los problemas administrativos planteados, como demuestra la creación de un cuerpo letrado específico, el de los primero 24 jueces y después 30 jueces, a cuyo cuidado quedó la fase de instrucción sobre el terreno de muchos juicios de residencia. Entre ellos, los de importantes ciudades cuya colaboración era imprescindible para obtener las contribuciones planteadas por la corona en la asamblea de Cortes iniciada en 1607. Tan eficaces se mostraron los treinta jueces como jueces de residencia en estas ciudades, que éstas tasaron su apoyo en la desaparición del joven cuerpo, concedida sin esperar a la formulación de los capítulos generales, mediante punto contenido en las Ordenanzas del Consejo Real de enero de 1608. Pese a su corta existencia, la potencial variedad de las comisiones que podían realizar, consagrada en su título, puede a su vez ser interpretada en clave de paulatina superación de la consabida división entre gobierno y justicia, a que se viene reduciendo la actividad administrativa durante la Edad Moderna.

[EN] Generally, the hispanic administration in time of Philip III has been considered as an expression of a general state of decadence. Such interpretation is common to the witness of those times and present historians. However, we believe that this idea admits revisión, because it is not coherent with the evident institutionalitation that the Hispanic monarchy keep carrying since the 1580's, from which the Royal Council constitutes an ideal example. In time of Philip III there were suitable formulas to confront the outlined administrative problems, as demonstrates the creation of a specific legal body, first 24 judges and later 30 judges, whose did the instruction stage on the ground of many inquiry triáis. Among them, important cities whose collaboration was indispensable to obtain the contributions outlined by the crown, in the assembly of Cortes initiated in 1607. So effective were the thirty judges like residence judges in these cities, that these appraised their support in the disparition of the young body, granted, without waiting to the formulation of the general chapters, by the way of contained point in the Ordinances of the Royal Council of january of 1608. In spite of their short existence, the potential variety of the commissions that they could carry out, consecrated in its title, can be interpreted in key of gradual superation of the traditional división among government and justice, that the administrative activity is being reduced during the modern age.
