Lex Ursonensis cap. 109 La tutela en la Lex Ursonensis en el ley municipal

Abstract

RESUMEN: La reconstrucción del cap. 109 de la lex Ursonensis, con la regulación de la datio tutoris, puede ser realizada a partir del pequeño fragmento 1 de los Bronces de El Rubio. Para ello se utiliza como base el cap. 29 de la ley Flavia municipal, que es expurgado de complementos o interpolaciones por diversos autores (Gradenwitz, Schulz, A. d'Ors y Consentini). Se analiza cada una de esas hipótesis y se defiende la de A. d'Ors utilizando distintos argumentos: uno formal, otro de fondo y un tercero acerca de lafacilior intervención sobre el texto legal.

ABSTRACT: Chapter 109 of the lex Ursonensis, which contains the System of datio tutoris, can be restored from fragment 1 of the Bronzes of El Rubio.That is made on the basis of the Flavian municipal law (chapter 29), cleansed of additions or interpolations by several authors (Grandenwitz, Schulz, A. d'Ors and Consentini). Each of these hypothesis is examined, to conclude choosing that of A. d'Ors by different reasons: one formal, another substancial, and a third about the facilior intervention in the legal text.
