dc.description.abstract | [ES]Los términos "anarquía" y "derecho", que en un principio pueden parecer antagónicos y poco relacionados entre sí, no lo son ni lo están tanto. Partiendo de las teorías defendidas por los principales anarquistas del siglo XIX, se llegaría a la conclusión de la existencia de un iusnaturalismo radical, se pondría de manifiesto una gran crítica al derecho legislado, al positivismo jurídico que tanta fuerza tenía en ese momento. ¿Es necesario un derecho penal anarquista? Si así fuera, ¿Cómo sería su sistema de sanciones penales? Éstas son algunas de las cuestiones a las que se trata de dar respuesta. la realización de un recorrido por las críticas del anarquismo, desde postulados marxistas hasta las realizadas por demócratas liberales en la sociedad actual, es de crucial importancia a la hora de contextualizar de manera correcta esta teoría política. | es_ES |
dc.description.abstract | [EN] The terms "anarchy" and "law" seem to be contradictory or, at least, unrelated to each other. It is not true, at least in legal philosophy. Anarchism is in heart of some iusnaturalism streams of legal philosophy, concretely the most radical ones; these approaches were specially prominent in the XIXth. Century, and they developed a deep criticism to legal positivism and, therefore, to the belief in the necessary respect to any written legislation. Secondly, we will intend to answer the question on the possibility of an anarchist criminal law, and what its catalogue of criminal punishments would be like. Finally, we will focus on the main criticism to the anarchist theories, from the marxist ones to the most salient nowadays. | es_EN |
