Propuesta de reforma de la legítima de los ascendientes en derecho común

Abstract

[ES] El presente trabajo pretende fundamentar una posible reforma del sistema legitimario español para otorgar al causante una mayor libertad de testar. Se expondrá de manera general la regulación sobre las legítimas, y seguidamente se pondrán de manifiesto los aspectos que deberían actualizarse de acuerdo a las circunstancias sociales y económicas actuales. En concreto, se pretende proponer una posible reforma en la legítima de los ascendientes sustituyéndola por un sistema alimenticio. Para ello, se pondrán de manifiesto las razones más relevantes para justificar el cambio tras analizar la situación de la sociedad actual, analizando también las regulaciones en otros ordenamientos de la referida legítima de los ascendientes e intentando argumentar su falta de necesidad en el momento contemporáneo Asimismo, muy relacionado con la institución estudiada, se plantea el problema del cónyuge viudo en la sucesión, proponiendo una mejora de su posición a través de varias alternativas.
