Garantias de los bienes de consumo: los remedios regulados legalmente frente a la falta de conformidad

Abstract

[ES] El Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias, regula en sus artículos 114 y siguientes las garantías de los bienes de consumo y los servicios posventa. Con este sistema se pretende la protección de los consumidores como parte débil del contrato frente a los vendedores cuando se produce una falta de conformidad del producto con el contrato. Especialmente se establecen presupuestos de responsabilidad del vendedor y de los derechos que tiene el consumidor mediante el ejercicio de cuatro acciones: reparación, sustitución, como remedios primarios; y rebaja del precio y resolución del contrato como remedios subsidiarios. Disponiéndose para el ejercicio de estas acciones, de un sistema de presunciones a favor del comprador con distintos plazos para el ejercicio de las acciones.

[EN] The Real Legislative Decree 1/2007, of 16 of November, approving the revised text of the General Law for the Protection of Consumers and Users and other complementary laws, regulates in their articles 114 and following the guarantees of consumer goods and after-sales services. With this system is intended the consumers’ protection as weak part of the contract against sellers when a lack of conformity of the product occurs with the contract. Especially acts of liability of the seller are established and the rights of the consumer through the exercise of four actions: repair, replacement, as primary remedies; and reduction of price and termination of contract as subsidiary remedies. Provided for the exercise of these actions, of a system of presumptions in favor of the consumer with different terms for the exercise of the actions.
