Las competencias del Estado como garantía de la unidad de mercado en la jurisprudencia constitucional

Abstract

Uno de los ejes esenciales de la Constitución española de 1978 es el principio de unidad territorial, junto a los de autonomía y solidaridad, en cuyo contenido sustantivo se integran tanto el interés general del Estado como el principio de unidad de mercado. Entre los instrumentos más importantes que el Ordenamiento Constitucional pone al servicio de su consecución y mantenimiento deben resaltarse las competencias del Estado. A lo largo de los años, la jurisprudencia del Tribunal Constitucional ha mantenido y reafirmado tales principios, tal como se trata de reflejar este trabajo, analizándola.

One of the essential elements of the Spanish Constitution of 1978 is the principle of territorial unity, together with autonomy and solidarity, in which substantive content both the general interest of the state as the principle of market unit are integrated. Among the most important tools that the Constitutional Planning makes available to its attainment and maintenance should highlight the powers of the State.
