La orden de protección de las víctimas de violencia de género: un análisis comparado

Abstract

[ES] La violencia de género es un problema social y global que afecta, no sólo a España, sino a todos los países de nuestro entorno. Con el fin de reducir la cantidad de mujeres afectadas anualmente por este tipo de violencia (física, psicológica, económica, sexual…), se ha buscado establecer una legislación protectora de la mujer víctima de violencia de género, ocupando un papel primordial a tal propósito la orden de protección. Sin embargo, ésta no ha sido adoptada por igual en todos los Estados Europeos y la nueva orden europea de protección no parece terminar por establecer unas reglas comunes. Este trabajo tiene por objeto el estudio de la orden de protección aplicada a las víctimas de violencia de género, tanto en el ámbito nacional como en el europeo. Así, en primer lugar, analizaremos la orden española de protección, adoptada mediante Ley 27/2003, para luego compararla con la situación existente en otros países europeos. A continuación, nos aproximaremos a la nueva Directiva 2011/99/UE, de reciente transposición a nuestro ordenamiento y que sigue los principios de reconocimiento mutuo de decisiones judiciales, equivalencia y confianza mutua.

[EN] Violence against women is a social and global issue which not only affects Spain, but also every single country around us. In order to reduce the amount of women affected annually by this kind of violence (both physical and psychological), protective legislation in favour of women who have been victims of violence against women has been established, for which protection orders are essential. Nevertheless, this has not been adopted equally in all European countries and common terms do not seem have been established by the new European protection order. This project undertakes a study of the protection order applied to victims of violence against women, in both the national and European fields. Therefore, at first, a Spanish protection order (adopted by Law 27/2003) will be analyzed, which can then be compared with the situation that exists in other European countries. We will then tackle the new Directive 2011/99/UE, recently introduced into our legal system, which follows the principles of mutual recognition, equivalence and mutual trust.
