Urbanismo y ordenación del territorio en Castilla y León

Abstract

[ES] En el presente trabajo nos centramos en el “Urbanismo y Ordenación del Territorio” en la Comunidad de Castilla y León. Con dicho trabajo se pretende analizar la evolución histórica que ha sufrido la legislación en esta materia. En primer lugar, se establecen los conceptos de “urbanismo” y de “ordenación del territorio”, a continuación se analiza la organización administrativa en esta materia, la cual corresponde a la Junta de Castilla y León. Por lo que veremos los órganos que la componen y las diferentes funciones que le han sido asignadas, todo ello poniéndolo en relación con la materia que nos ocupa. Seguidamente se hace referencia al Estatuto de Autonomía original de la Comunidad, para después analizar sus posteriores reformas. Lo que permite conocer cuáles han sido los cambios introducidos y cuál ha sido su evolución. Por otro lado, profundizaremos en la Ley de Ordenación del Territorio. Y finalmente analizaremos la normativa urbanística de la Comunidad destacando sus objetivos y principios, así como lo referente al régimen del suelo, planeamiento, ejecución y gestión y por último haremos una referencia a la disciplina urbanística.

[EN] In this paper we focus on the "Urban and Regional Planning" in the community of Castilla y León. With this work is to analyze the historical evolution that has undergone the relevant legislation. The concepts of "urban" and "planning" then the administrative organization in this field, which corresponds to the Castilla y León sets is analyzed first. As we will see the constituent bodies and the different roles they have been assigned, all putting in relation to the matter at hand. Reference is made to the statute of autonomy originating in the community, and then analyze its subsequent amendments. Which allows to know what were the changes and what has been its evolution. On the other hand, delve into the Planning Act. And finally discuss the planning regulations of the community highlighting their objectives, principles and respect the land, planning, implementation and management regime and finally we will refer to the planning discipline.
