Resumen
[ES] La vivienda familiar suele ser uno de los bienes más valiosos de los que disponen los cónyuges, por lo que en los casos de nulidad, separación o divorcio la atribución del uso del domicilio familiar es una de las decisiones con mayor trascendencia tanto para los cónyuges como para los hijos comunes en el caso de que existan. Esta atribución puede ser adoptada de mutuo acuerdo entre los cónyuges o mediante resolución judicial a falta de acuerdo entre éstos. En este trabajo analizaremos los criterios que se han de tener en cuenta para asignar el uso de la vivienda familiar, que no pueden estar condicionados exclusivamente por el dato de la titularidad que se tenga sobre la misma y que están íntimamente relacionados con el régimen de custodia que se acuerde respecto a los hijos comunes. Se estudiarán los criterios recogidos en el artículo 96 del Código Civil, así como la interesante jurisprudencia que existe sobre la materia y la regulación de algunas Comunidades Autónomas con competencia en este ámbito. [EN] The family dwelling is often one of the most valuable assets available to the spouses and in cases of annulment, separation or divorce the attribution of the use of the family dwelling is one of the most important decisions and with greater significance for both spouses as well as for joint children in the case of that exist. This granting may be adopted in mutual agreement between the spouses or by means of judicial resolution in the absence of agreement between these. In this project we will analyze the criteria that have to be born in mind to assign the use of the familiar house. These cannot be determined exclusively by the information of the ownership of this one. Also they are intimately related to the regime of custody that has been agreed with regard to the common children. The criteria gathered in the article 96 of the Civil Code will be studied, as well as the interesting jurisprudence that exists on the matter and the regulation of some Autonomous Communities with competition in this area.
