Evolución de la regulación de los sistemas de garantía de los depósitos en las entidades de crédito

Abstract

[ES] El tema a abordar son las reformas acontecidas en la regulación de los Fondos de Garantía de Depósitos. Para ello se hace referencia a la Directiva 94/19/CE y al RD 2606/1996, que regulaban los tres fondos existentes en España hasta 2011, uno para los depósitos en entidades bancarias, otro para los depósitos en cajas de ahorro y otro más para los depósitos en cooperativas de crédito. Por otra parte, se analiza el RDL 16/2011, que creó el actual Fondo de Garantía de Depósitos de Entidades de Crédito, y la Directiva 2014/49/UE. Todo ello se pone en relación con la crisis financiera iniciada en los años 2007-2008.

[EN] The issue to be addressed is the reform occurred in the regulation of the Deposit Guarantee Funds. On one hand, it makes a reference to the Directive 94/19/CE and the Royal Decree 2606/1996, which regulated the three existing funds in Spain until 2011, one for the deposits in banks, another one for the deposits in savings accounts and a last one for the deposits in credit unions. On the other hand, it analyzes the Royal Decree-Law 16/2011, which created the current Guarantee Fund of Credit Institutions, and the Directive 2014/49. Putting all of it in relation with the financial crisis began in 2007-2008.
