Matrimonio musulmán y su eficacia civil en España

Abstract

[ES] La creciente inmigración y el consiguiente aumento de población de credo musulmán en España han dado lugar al denominado “choque de civilizaciones”. Esta situación afecta al Derecho de Familia y por lo tanto al derecho matrimonial, haciendo necesario el establecimiento de acuerdos entre el Estado español y la religión islámica. El descubrimiento de las posibles vías de adecuación de las minorías religiosas en el Derecho español, debido al sistema multicultural en el que nos encontramos y la integración social de las minorías, se hace ineludible. El objetivo de este trabajo es analizar la celebración del matrimonio islámico en España, el reconocimiento de su eficacia civil y los posibles conflictos que se plantean con nuestro ordenamiento jurídico.

[EN] The increase immigration and consequently the increase of islamic population in Spain has lead to a “clash of civilizations”. This situation affects both: family law and marriage law, making it a necessity to establish agreements between the Spanish state and Islam. The discovery of possible alternatives to adjusting religious minorities into the Spanish law, both due to the multicultural system that we live in and to the need for social integration, becomes unavoidable. The objective of this research is to analyze the celebration of islamic marriage in Spain, the recognition of its civil efficiency and the possible conflicts that arise with our judicial code of law.
