El papel de la víctima en el derecho penal

Abstract

[ES] En el presente trabajo se pretende analizar el papel que desempeña la víctima en el Derecho penal, diferenciándose como víctima en un sentido estricto, como ofendido o sujeto pasivo del delito, y en un sentido amplio, como aquellos perjudicados por las consecuencias negativas del hecho delictivo. Para ello se realizará este estudio siguiendo las distintas categorías que comprenden la estructura de la teoría del delito. Posteriormente se examinará su intervención en la fase postdelictual, en relación a la figura del perdón del ofendido, y en los mecanismos de Justicia Restaurativa, prestando especial atención a la mediación penal. Para finalizar se comentará el amplio catálogo de derechos reconocidos tras la aprobación de la Ley 4/2015, de 27 de abril, del Estatuto de la víctima del delito.

[EN] This text aims to analyze the victim’s role in the Spanish criminal law. The summary purport to separate strict sense of a victim, who show itself as a displeased or passive fellow of a crime, and in a broad sense, as those affected by the negative consequences of malfeasance. This research will be implemented developing different ranks which integrate the structure theory of crime. After of this step, the displeased will be analyze his intervention at the after crime phase in relation to the figure of forgiveness of the victim and the mechanisms of restorative justice, with special attention to criminal mediation. To complete the comprehensive catalog of rights recognized in Law 4/2015, of the Statute of the crime victim will be discussed.
