Lexnet: funcionamiento y problemática

Abstract

[ES] La implantación de las nuevas tecnologías de la información en los órganos judiciales tiene como principales objetivos aumentar la eficacia y la celeridad del sistema judicial. Para ello se ha incorporado desde el año 2016 un sistema securizado de intercambio de información entre profesionales de justicia y el órgano judicial de obligatorio uso, Lexnet. Este sistema opera de forma similar al de un correo electrónico y mediante el mismo los profesionales de justicia envían los escritos al órgano judicial y reciben las notificaciones. El sistema tiene como objeto avanzar en la política de “papel cero” en el sistema judicial y así conseguir una justicia de mayor calidad y rapidez en la resolución de los procesos. No obstante, este sistema no ha estado libre de controversia y críticas desde su aplicación en la oficina judicial. Los potenciales colapsos que puedan producir las caídas del sistema, las consecuencias de un fallo en las notificaciones o la imposibilidad de instalar el sistema en sistemas operativos de software libre han sido algunas de las críticas que ha recibido. Asimismo, su gestión por parte del Ministerio de Justicia ha despertado la preocupación de parte del sector de justicia dada la posibilidad de que exista una intromisión en los datos manejados por el sistema y se produzca una falta a la independencia del Poder Judicial.

[EN] The implementation of information and communications technology on the judicial bodies has the primary aim of increase the effectiveness and celerity of the judicial system. To this end, from the 2016 a new secured information exchange sistem has been incorporated. This system operation is similar to the web mail and through it the justice practitioners send the documents to the judicial body and they receive the notifications. The system has as primary aim to advance on the “cero paper” policy and get a high quality justice and quickness in the resolution process. However, this system has not been free of controversy and criticism from its implementation in the judicial office. The potential collapse that may produce the system crash, the fails consecuences in the notifications or the imposibility to install the system in a free software operating system have been some of the criticisims recieved. Furthermore, its management by the Justice Department has raised concerns by a section of the justice sector because the posibility of an interference on the data administered by the system and the production of a lack of Independence on the Judicial Power.
