Cuestiones matrimoniales: la custodia compartida

Abstract

[ES] El título de este Trabajo de Fin de Título Propio es “Cuestiones matrimoniales: La custodia compartida”. El presente trabajo aborda los aspectos teóricos y prácticos de la custodia compartida como una de las posibles modalidades de determinación de la guarda y custodia tras la ruptura de la convivencia en pareja. El tema principal del estudio es el análisis de la situación actual de la custodia compartida, centrándonos especialmente en la evolución de esta figura a través de las modificaciones legales recientes, y a través de las líneas doctrinales imperantes en los tribunales en estos momentos. Este estudio de la custodia compartida abarcará su regulación legal a través de las modificaciones legislativas recientes, sus formas de determinación, sus efectos, la interpretación doctrinal de sus elementos y circunstancias, sus medios de prueba pertinentes y la modificación del régimen de custodia compartida. Por último, tras un breve análisis de la legislación autonómica en materia de custodia compartida, el presente trabajo finalizará con las conclusiones que personalmente se han extraído del estudio de la custodia compartida.

[EN] The title of this Master's degree job is "Matrimonial Issues: Shared Custody." The present work deals with the theoretical and practical aspects of shared custody as one of the possible modalities for the determination of custody after the breakup of coexistence in couples. The main theme of the study is the analysis of the current situation of shared custody, focusing especially on the evolution of this figure through recent legal modifications, and through the doctrinal lines prevailing in the courts at the moment. This study of shared custody will cover its legal regulation through recent legislative changes, its forms of determination, its effects, the doctrinal interpretation of its elements and circumstances, its relevant means of evidence and the modification of the shared custody regime. Finally, after a brief analysis of the autonomous legislation on shared custody, this present work will conclude with the conclusions that have been drawn personally from the study of shared custody.
