El nuevo delito del acoso o acecho obsesivo ("delito de stalking") del artículo 172 ter del Código Penal

Abstract

[ES] Este estudio pretende analizar la inclusión del nuevo delito de acoso o stalking en el ordenamiento jurídico español. En primer lugar se definirá el concepto de acecho o de acoso predatorio, haciendo una breve descripción de sus orígenes en el país precursor de este delito los Estados Unidos. A continuación se hará una especial mención al stalker o autor del acoso, dando a conocer sus caractreerírsticas, tipos de acosadores, las motivaciones que puede llevar a cabo esta conducta, como la elaboración de un perfil de un posible stalker basado en los estudios elaborados en otros países. Seguiremos con el estudio de la víctima del acoso, el cual consideramos que es una parte muy importante en este tipo de conducta por lo que llevará parte del trabajo. Destacar la dificultad que la víctima tiene ante un nuevo delito donde todavía no hay mucha información, consecuencias del delito, relación con otras formas de violencia y la cifra negra serán cuestiones a tratar. Proseguiremos con la numeración de los casos más repetidos en la conducta del stalking, como de la introducción de este delito en las nuevas tecnologías (ciberstalking) y terminaremos con el análisis del artículo 172 ter (CP), la actuación del ordenamiento jurídico anterior a la reforma y la relación con el derecho comparado.

[EN] This study aims to analyze the inclusion of the new offense of harassment or stalking in the Spanish legal system. First the concept of stalking or harassment is defined predatory, with a brief description of its origins in the country precursor of this crime the United States. Then a special mention to the stalker or harasser will be made, providing its characteristics, types of stalkers, the otivations that can perform this behavior, such as developing a profile of a possible stalker based on the studies produced other countries. We will continue with the study of the victim of harassment, which we believe is a very important in this type of conduct which take part of the work. Highlight the difficulty that the victim has before a new crime where there is still a lot of information, consequences of crime on health, relation to other forms of violence and the dark figure will be issues to deal with. We will continue with the numbering of cases most often repeated in the conduct of stalking, and the introduction of this crime on new technologies (ciberstalking) and finish with the analysis of Article 172b (CP), the performance of the previous law to regarding reform and comparative law.
