La Orden Europea de Protección: un análisis comparado

Abstract

[ES]La igualdad de entre mujeres y hombres se constituye como uno de los derechos fundamentales reconocidos tanto en el ordenamiento jurídico europeo como en el español. A pesar de ello, la propia Unión Europea ha reconocido que, en tanto en cuanto el principio de igualdad significa la total ausencia de toda discriminación, directa o indirecta, este no se ha visto materializado en su totalidad, siendo una de sus manifestaciones más claras la violencia de género. En este marco, el presente Trabajo de Fin de Grado tiene como objetivo analizar la Orden Europea de Protección, la Directiva 2011/99/UE y la Ley 23/2014. Asimismo, mediante un análisis de Derecho comparado se llevará a cabo un estudio intensivo de la Orden de Protección regulada en el marco jurídico español y en otros marcos europeos, como el austriaco, alemán, italiano o francés; para tratar de determinar así cuales son las similitudes y diferencias de la Orden Europea de Protección respecto a las reguladas en estos países, así como si la Orden Europea ha cumplido con sus objetivos.

[EN]Equality between women and men represents one of the fundamental rights acknowledge in both European and Spanish legal order. Nonetheless, the European Union itself agreed that although equality is the total absence of discrimination, either direct or indirect, it has not been fully materialised, and gender-based violence is its most obvious exposure. Within this frame, the following final degree project’s objective is to analyse the European Protection Order, Directive 2011/99/UE and Law 23/2014. In addition, through the analysis of comparative Law, the Protection Order within the Spanish legal order will be thoroughly studied and compared to those within the Austrian, German, Italian and French orders. The project will also determine the similarities and differences between the European Protection Order and the orders in these countries, as well as whether the first has achieved its goals.
