Abstract

[ES] En el presente trabajo nos centraremos en el “Urbanismo y Ordenación del territorio”, analizando la evolución que han sufrido las distintas legislaciones en los últimos años en el marco histórico de la crisis económica caracterizada en estos años en España. En primer lugar, analizaremos el objeto y la finalidad del Real Decreto Legislativo 2/2008, de 20 de Junio, que aprueba el Texto Refundido de la Ley de Suelo. Seguidamente, analizaremos la Ley 8/2013, de 26 de Junio, de Rehabilitación, Regeneración y Renovación Urbanas, en ese análisis, estudiaremos su ámbito de aprobación, objeto y finalidad. A continuación, haremos destacar las diferencias entre estas dos legislaciones, ya que la LRRRU de 2013 produjo un cambio drástico de lo que se venía regulando en España. Por otro lado, profundizaremos en el Real Decreto Legislativo 7/2015, de 30 de Octubre, por el que se aprueba el Texto Refundido de la Ley de Suelo y Rehabilitación Urbana. Finalmente, hacemos un análisis profundo sobre el Texto Refundido de la Ley de Suelo y Rehabilitación Urbana en relación con la Ley de Suelo y la Ley Rehabilitación, Regeneración y Renovación Urbanas, realizando una comparación de los textos.

[EN] In the present work we are going to focus on “Urban and land-use Planning”, analyzing the evolution that different legislations have suffered in last years in this historical frame of economical crisis, characterized these years in Spain. First of all, we will analyze the object and the purpose of Legislative Royal Decree 2/2008, of June 20, which approves the Refunded Text of Soil Law. To continue with, we will analyze the Law 8/2013, of June 26, about rehabilitation, urban regeneration and renovation; in that analysis, we will study its approval area, object and purpose. The following will be emphasizing in differences between these two legislations, as drastic changes that the LRRRU 8/2013 produced in Spain regulation. On the other hand, we will study deeply the Legislative Royal Decree 7/2015, of October 30, by which there was approved the Refunded Text of Soil Law and Urban Rehabilitation. Finally, we will make a deep analysis about Refunded Text of Soil Law and Urban Rehabilitation, in connection with Soil Law and Rehabilitation, Regeneration and Renovation Law, making an article comparative.
