Resumen
[ES]La gestación por sustitución en los últimos años viene siendo la técnica de reproducción
humana asistida más utilizada por las parejas o familias monoparentales para poder
colmar su deseo de ser padres cuando no lo pueden ser de manera natural o mediante
fecundación in vitro. Sin embargo, esta técnica está expresamente prohibida por el art.
10 LTRHA, llevando a que se practique fuera de nuestras fronteras por nuestros
nacionales, lo que provoca una gran cantidad de problemas después de que el niño haya
nacido. Este trabajo tiene como objetivo hacer un estudio sobre la situación que se
provoca en el momento de la inscripción en el Registro civil y cómo tanto la
jurisprudencia española como la Dirección General del Registro y del Notariado tiene
una perspectiva muy diferente del problema que se genera. Además, se hará un análisis
de la aprobación de una posible ley de gestación por sustitución presentada
recientemente en el Congreso de los Diputados. [EN]In the last few years, subrrogate pregnancy has been the most used technique of assisted
human reproduction to fulfil the desire of single-parent families and couples to be
parents when they cannot be by natural means or through in vitro fertilization.
Nevertheless, this procedure is strictly forbidden by article 10 LTRHA, leading to its
practise beyond our borders by our own nationals, which causes a lot of problems after
the birth of the child. The purpose of this work was to do a study on the situation that
arises at the time of registration in the Civil Registry and how both the Spanish case
law and the General Directorate of the Registry and Notaries have a very different
perspective of the problem generated. In addition, an analysis of the approval of a
possible law of gestation by substitution presented recently in the Congress of Deputies
will be made.
