La Justicia Restaurativa como método alternativo de resolución de conflictos y su implementación en España

Abstract

[ES]En este trabajo se analiza cómo la justicia restaurativa es una buena alternativa a la justicia retributiva en la resolución de ciertos conflictos cuyos implicados son menores de edad. Después de definir los objetivos principales de los programas restaurativos, presentaré los efectos positivos que producen en el ofensor así como en la víctima y la sociedad. Por otra parte estudiaré si las prácticas restaurativas están totalmente aceptadas en España y explicaré los motivos de su éxito o fracaso. Al final indicaré cómo se reduciría la tasa de reincidencia y se lograría un mayor bienestar social con la implantación de estos programas dado que, en numerosos casos, devolver el conflicto a los implicados (víctima y ofensor) puede ser la solución más adecuada.

[EN]I argue that restorative justice is a suitable alternative to retributive justice in conflicts involving minors. Having defined the main objectives of Restorative programs, I show their positive effects on offenders, victims and the society. We will also see that restorative justice practises are not totally accepted in Spain and I shall explain why. Finally I shall show that with the implementation of these programs, the recidivism rate could be reduced and a greater social welfare could be achieved, since in many cases the best solution is to let victims and offenders to look for a solution by themselves.
