El Consejo General del Poder Judicial y sus figuras homólogas en Francia, Italia y Portugual

Abstract

[ES] El Consejo General del Poder Judicial fue creado por la Constitución Española de 1978 como el órgano de gobierno del Poder Judicial en España, cuya función principal es velar por la independencia de Jueces y Magistrados garantizando la no intromisión del resto de poderes del Estado en el mismo. Desafortunadamente, tanto su composición como la forma de elección de sus miembros se han visto influenciadas por la injerencia del Poder Ejecutivo, lo que nos lleva a realizar una importante crítica a la politización del CGPJ, una cuestión de especial relevancia a la hora de analizar un órgano de esta índole. Además, la creación del CGPJ se ha visto inspirada por los modelos de otros países próximos geográficamente (Francia, Italia y Portugal), lo que supuso una novedad en el sistema judicial español, razón por la que además de enfocar este trabajo en la composición, forma de elección y atribuciones de nuestro Consejo, también realizamos, a rasgos generales, un examen de los llamados Consejos Superiores de la Magistratura de los mencionados países, haciendo un pequeño análisis comparativo con el que podremos observar las similitudes y diferencias que presentan con respecto al modelo español.

[EN] The General Council of the Judiciary was created by the Spanish Constitution of 1978 as the governing body of the Judiciary in Spain, whose main function is to ensure the independence of Judges and Magistrates guaranteeing the non-interference of the other State’s powers. Unfortunately, both its composition and the election of its members have been influenced by the interference of the Executive Branch, which brings us to make an important critique of the politicization of the CGPJ, a particulary important matter when analyzing an organ of this nature. In addition, the creation of the CGPJ was inspired by models of other geographically close countries (France, Italy and Portugal), which was a novelty in the Spanish judicial system, for which reason, in addition to focusing this work on the composition, the election way and the attributions of our Council, we will also carry out, in general terms, an examination of the so-called Supreme Councils of the Judiciary of the mentioned countries, making a small comparative analysis with which we will be able to observe the similarities and differences that they have with the Spanish model.
