| dc.description.abstract | [ES] En el presente trabajo, tratamos de analizar cómo se llevó a cabo la evolución de la propiedad en la experiencia jurídica romana. Se trata de observar como el avance de la sociedad romana, su forma de entender la institución de la familia y del propio individuo, afectan necesariamente a la concepción del derecho de propiedad. En primer lugar, veremos el contexto histórico en el que se desarrolla el derecho de propiedad. Veremos como a partir de la existencia de una única clase de propiedad reconocida por el derecho civil romano, el dominium ex iure quiritium, aparecen otras formas de propiedad atendiendo a las demandas de protección que suscitaba la sociedad de la época y a las que el pretor ofrecerá solución a través del ius honorarium mediante las acciones honorarias. Analizaremos de manera pormenorizada cada una de esas clases de propiedad, así como su defensa procesal y los modos de adquisición que se reconocían en el derecho romano, distinguiendo por un lado, los modos originarios, y por otro lado, los modos derivativos. En último lugar concluiremos analizando las distintas limitaciones existentes a ese derecho de propiedad. | es_ES |
| dc.description.abstract | [EN] In the following document we will be analyzing how the development of the property took place in the Roman juridical experience. We will handle with the observance of how the progress of the Roman society, their way of understanding the family institution and the own individual necessarily altered the conception of the right to property. In the first place, we will see the historical context in which the right to property was developed. We will observe how from just one recognized conception of property by the Roman civil law, the dominium ex iure Quiritium, some other forms of property appeared due to the protection demands which aroused from the society of the time and to which the magistrate would give solution through the ius honorarium and the honorary actions. Moreover, we will analyze in a minor way, each of those forms of property, as well as their procedural defense and the ways of acquisition recognized in the Roman Law, distinguishing on the one hand the original way and on the other hand the derivative modes. In the last place, we will conclude by analyzing the different limitations which existed to that property right. | |
