La dispensa de la obligación de declarar en materia de violencia de género

Abstract

[ES] En la actualidad, un ingente número de procedimientos de violencia de género se ven frustrados debido a la negativa de la víctima a prestar declaración, como consecuencia del ejercicio del derecho constitucional, que la dispensa de la obligación de declarar en contra de su cónyuge, y al mismo tiempo, agresor, art 416 LECrim. En la mayoría de los casos, la ausencia de la declaración de la víctima, fomentada y acompañada por el mutismo del maltratador, impiden la prosecución del proceso, pues por lo general, son éstas las únicas evidencias de la realidad que se da en el domicilio familiar. Ante éstas circunstancias, es ya un imperativo el indagar remedios que impidan la impunidad de los agresores, y al mismo tiempo, satisfagan las necesidades de las mujeres víctimas, que no siempre se materializan en la obtención de condenas. Todo ello, acorde con el marco constitucional. Además, conviene plantearse qué hay detrás de la negativa de las víctimas de violencia de género, y para ello, es imprescindible recordar la naturaleza de éstos delitos, que someten a las mujeres a una multiplicidad de variables, como la dependencia económica, miedo a las represalias o la vinculación afectiva con el agresor.

In these circumstances, it is already an imperative investigating remedies that prevent the impunity of the aggressors, and at the same time, there satisfy the needs of the woman victims, who not always materialize in the condemnations securing, and all this, according to the constitutional frame. Also, it is convenient to appear what is behind the denial of the victims of gender violence, and for it, it is essential to remember the nature of these crimes, which they submit to the women to a multiplicity of variables, like the economic dependence, fear of the consequences, or the emotional ties with the aggressor
