La regulación internacional del uso de drones en conflictos armados: su empleo por Estados Unidos en Pakistán y Afganistán

Abstract

[ES] En el presente trabajo se estudia la aparición de la tecnología de los vehículos aéreos no tripulados, comúnmente conocidos como drones. En concreto, se aborda el desarrollo y la proliferación de los drones militares que son utilizados como arma en diferentes conflictos armados. La ausencia de Derecho positivo que regule la utilización de los drones no impide reflexionar sobre la legitimidad y la legalidad de los vehículos aéreos no tripulados como arma y como método de combate en virtud de las disposiciones convencionales y las normas consuetudinarias del Derecho Internacional Humanitario. Por último, acudiendo a ejemplos de práctica, se analiza la utilización de drones en los territorios de Pakistán y de Afganistán, donde Estados Unidos realiza diferentes operaciones militares basándose en las prácticas de los targeted killings y los signature killings para luchar contra diferentes organizaciones y grupos terroristas.

[EN] This project studies the new technology of the Unmanned Aereal Vehicles (UAV), usually known as drones. Specifically, it tries to analyse the development and proliferation of military drones that nowadays are used as weapons in different armed conflicts. The lack of legislation about these semi-automatic machines, does not prevent us from making an analysis about the legitimacy and the legality of the use of drones as a mean of warfare and as a method of warfare according to the provisions and customary law of International Humanitarian Law. In the same way, we study the use of drones in the territories of Pakistan and Afghanistan, where the United States is performing different military operations based on the practices of targeted killings and signature killings, with the objective of fighting against different terrorist organisations.
