Mecanismos legales para la localización de bienes del ejecutado

Abstract

[ES] Este trabajo de fin de grado analiza, desde el punto de vista práctico, los mecanismos legales de investigación de bienes del ejecutado que se ponen a disposición del ejecutante, para conseguir la eficacia en el proceso de ejecución. Entre los mecanismos más destacadas, nos encontramos con la manifestación de bienes (Art 589 LEC) con la que se pretende obtener una relación del patrimonio que dispone el ejecutado, para así poder determinar el objeto de embargo, poniendo de relieve su regulación escasa e imprecisa. Otra de las posibilidades que tiene el ejecutante, es solicitar la investigación judicial del patrimonio del ejecutado (Art 590 LEC) a través del Punto Neutro Judicial. De esta forma, será el Letrado de la Administración de Justicia el que recabará la información ya sea de un órgano público o privado, para que le facilite los bienes y derechos de los que pueda tener constancia el propio deudor.

[EN] This end-of-grade project analyzes, from the practical point of view, the legal mechanisms of investigation of the executives' assets that are made available to the performer, in order to achieve effectiveness in the execution process. Among the most prominent mechanisms, we find the manifestation of assets (Art 589 LEC) with which it is sought to obtain a list of the assets available to the foreigner, in order to determine the object of the embargo, highlighting its scarce and imprecise regulation. Another possibility that the performer has is to request a judicial investigation of the foreigner's assets through the Neutral Judicial Point. In this way, it will be the Lawyer of the Administration of Justice who will obtain the information from a public or private body, so that it will provide him with the assets and rights that the debtor himself may have recorded.
