El matrimonio islámico y sus efectos civiles en España

Abstract

[ES] El matrimonio islámico es hoy uno de los temas más controvertidos. Su regulación por la ley islámica presenta importantes desavenencias con las prescripciones en materia matrimonial de los Estados occidentales, sin embargo, la proclamación de los principios de libertad religiosa y de cooperación en la Constitución Española de 1978, obligaron al legislador español a dar solución a las necesidades de las minorías religiosas. De este modo, el presente trabajo se encuentra dirigido al estudio de la institución matrimonial desde un doble ámbito, la ley islámica y la normativa española aplicable a la celebración del matrimonio en forma religiosa a fin de reconocer eficacia civil a este tipo de matrimonio.

[EN] Nowadays, Islamic marriage is a great controversial issue. Its regulation by Islamic law presents major disagreements with the requirements in Western States´ matrimonial matters. However, the Spanish legislator has the obligation of attend the religious minorities needs, since the Spanish Constitution of 1978 proclaims the principles of religious freedom and cooperation. In this way, the aim of the present work is to study the marriage institution from a double scope. On the one hand, the Islamic law by itself, on the other hand the Spanish regulations applicable to the celebration of marriage in religious form, in order to recognize civil effectiveness to this type of marriage
