La protección patrimonial de las personas con discapacidad

Abstract

[ES] Siendo conscientes de que las personas con discapacidad pueden ver reducida su integridad como persona, urge reflexionar ante esta situación tan injusta y sobre el papel que nos corresponde como ciudadanos en la construcción de una sociedad que respete los derechos de todas las personas, más allá de sus limitaciones. Por esta razón el objetivo de este trabajo es estudiar la protección jurídica del patrimonio de los discapacitados, la cual queda inmediata y directamente vinculada a la satisfacción de las necesidades vitales de sus titulares, favoreciendo la constitución de este patrimonio y la aportación a título gratuito de bienes y derechos a esa masa patrimonial. Los bienes y derechos que forman este patrimonio, se aíslan del resto del patrimonio personal de su titular-beneficiario, sometiéndolos a un régimen de administración y supervisión específico, que es objeto de análisis en este trabajo. Los beneficiarios de este patrimonio pueden ser, exclusivamente, las personas con discapacidad afectadas por unos determinados grados de minusvalía, y ello con independencia de que concurran o no en ellas las causas de incapacitación judicial contempladas en el art 200 del CC y de que, concurriendo, tales personas hayan sido o no judicialmente incapacitadas.

[EN] While being aware that disabled people may find their integrity as people limited, it is important for us to reflect on such an unjust situation as citizens facing our role in the construction of a society which respects everybody’s rights, beyond their limitations. Therefore, the aim of this work is to study the legal protection of disabled people’s heritage, which is directly linked to the satisfaction of the vital needs of the beneficiaries, by favouring the constitution of said heritage and the free transfer of assets and rights of this heritage. The rights and assets which make up said heritage are separate from the remaining personal heritage of holders/beneficiaries, and undergo a specific regime of administration and supervision, which is the aim of the present work of analysis. The beneficiaries of this heritage may be, exclusively, disabled people affected by certain degrees of disability, independently of whether or not they coincide with legal incapacitation under article 200 of the Civil Code, and whether said people have been legally incapacitated or not.
