El blindaje constitucional de las pensiones y los retos de los derechos sociales hoy

Abstract

[ES] Durante los últimos años, los ancianos españoles han alzado la voz para pedir mejores pensiones de jubilación. Este movimiento ha llevado a la creación de una plataforma que reúne a gente que pide una mayor protección constitucional para las pensiones. Su objetivo es que se prohíba cualquier privatización del sistema de Seguridad Social además de que se garantiza una progresiva actualización del monto de las pensiones mediante la plasmación en el texto constitucional. Una propuesta como ésta toca el mismo corazón de los derechos sociales. Por tanto, en este trabajo trataremos de descubrir los pros y contras de una iniciativa mediante un análisis en profundidad de la teoría de los derechos sociales. Esto incluye, por ejemplo, preguntarnos sobre su naturaleza y nivel de ―fundamentalidad‖, pero también por la capacidad de nuestro sistema jurídico para garantizar de forma efectiva los derechos sociales. Veremos cómo se enfrentan a asuntos tanto ideológicos como prácticas, ya que dependen de un sustrato económico. Por añadidura, este estatus frágil se refleja en el menor nivel de protección garantizado a los principios rectores (la mayoría de los cuales son derechos sociales) en la Constitución Española. La legislación vigente sobre pensiones, la jurisprudencia y el contexto internacional también serán tomados en cuenta, así como una panorámica sobre la conveniencia o no de ampliar el contenido de la Constitución.

[EN] During the latest years, elders in Spain have raised their voices to ask for better retirement pensions. This movement has led to the creation of a platform that gathers petitioners for higher constitutional protection regarding pensions. Their aim is to forbid any privatization of the Social Security System as well as to guarantee the progressive updating of the amount of each pension through its inclusion within the Constitutional text. A proposal like this touches the very core of social rights. Therefore, in this paper we aim to discover the pros and cons of this initiative by analysing the theory of social rights in depth. This includes, for instance, questioning their nature and level of ―fundamentality‖, but also the capability of our juridical system to effectively guarantee the content of social rights. We will see how these rights face both practical and ideological issues, as they have to rely heavily on an economic base. Moreover, this fragile status is reflected onto the lesser level of protection granted to the ―guiding principles‖ (most of which are social rights) in the Spanish Constitution. The current regulation of pensions, jurisprudence and international context is also taking into account, alongside an overview on the convenience or not of broadening the content of the Constitution.
