dc.description.abstract[ES] La erradicación de la tortura tanto en sistemas democráticos como no democráticos ha sido uno de los objetivos estrella de las organizaciones internacionales que tratan asuntos de Derechos Humanos, así como de las ONGs de este campo. Esta lucha ha tenido una especial atención en Estados con cualquier tipo de conflicto interno entre el Estado y otro Estado, un ente regional dentro del mismo, una organización terrorista, etc., dada la mayor probabilidad de tortura en estas situaciones. En el presente estudio, se analizarán los casos provenientes de España que han llegado al Tribunal Europeo de Derechos Humanos en materia de delito de tortura y falta de investigación de las mismas. Para ello, se realizará primeramente un deslinde de los conceptos básicos para entender el resto del cuerpo de este trabajo, así como una contextualización del conflicto en el que se circunscriben los casos: el conflicto entre el Estado español y ETA. Seguidamente, se analizarán los aspectos comunes de todas las sentencias, complementándolo con una recopilación de las recomendaciones internacionales en torno a la presencia de la tortura en España y con una perspectiva de género y otra desde la Ciencia Política para finalizar.es_ES
dc.description.abstract[EN] The elimination of the torture in both democratic and non-democratic systems has been one of the main objectives of the international organisations and NGOs that work on Human Rights. This struggle has been focused on States in which internal conflicts have developed, whether they concern one State against another State, or against a regional government or a terrorist organisation, due to the increase of the probabilities of torture in these situations. This essay will analyze the Spanish case law related to torture and the lack of support of torture investigations that have been considered by the European Court of Human Rights. First, those concepts that are necessary in order to understand the rest of the essay will be studied from different perspectives. Furthermore, there will be an exposition of the context of the Basque conflict in Spain, between the Spanish government and the terrorist organisation ETA. Finally, the common aspects of the case law will be extracted in order to complement them with a list of recommendations from international organisations about the elimination of torture in Spain and from both a Gender and Political Science perspective to conclude.en

dc.description.application[EN] In the present work the financing of the political parties is going to treat in Spain his sources, which are that they give operability to the same ones, the initials and those who are used today, the regulation that he them has been accompanying in these 40 years since the democracy was restored and with her the system of parties in representation of the popular will across these and of the corresponding suffrages. We will approach both principal sources of financing that are given in a mixed system as the Spanish and these are the public financing and the private financing, the critiques that are done to the same ones in relation with which it adjusts more with the model. We will study a great problematics that is given concerning the financing, which is the political corruption and his effects. We will analyze the different juridical regulation that has been arising in altars of this financing to try to take an effective control of these public and private flows. We will differentiate two periods in the activities of these entities, the ordinary and extraordinary financing and his different measures. Finally we will see the organ that takes charge controlling this economic - financial activity of these, the so called Court of Accounts and his different measures and reports.en
