El significado sociológico de la Teoría del Derecho Penal del enemigo

Abstract

[ES] Como producto de los nuevos retos de la política criminal contemporánea de matiz funcionalista, nace teóricamente, la Teoría del Derecho Penal del enemigo, de los estudios de Günther Jakobs, que busca dar respuesta normativa a estos nuevos retos de forma eficiente, con el fin de minimizar las amenazas del Sistema Social, lo que tiene importancia para el Derecho Penal, de acuerdo con dicho autor. Esta teoría establece que un ser humano que no presenta garantía cognitiva alguna para la sociedad, que no ofrece la menor condición de atender a las mínimas expectativas normativas necesarias y esenciales para la vida en sociedad, debe ser tratado por el sistema social de forma diferente de la forma utilizada para el ciudadano regular, aquel que se presenta hábil para cumplir con sus deberes de diligencia y respeto a los derechos ajenos, consubstanciados en las expectativas normativas institucionalizadas por el sistema social. Dicha teoría establece que haber dos Derechos Penales, para diferentes clases de personas en la sociedad, de acuerdo con lo que se explicará. Jakobs sostiene que fundamenta su forma sociológica de observar el derecho penal en la Teoría Funcional de Sistemas Sociales de Niklas Luhmann.

[EN] The criminal law for the enemy theory - A contemporary debate on the balance between the necessary fight against mass criminal phenomena and the protection of human rights. In this thesis we present a criminal policy‘s theory called criminal law for the enemy and the paths that make could possible the formal and material justification of the statutes based on it‘s values. To do so, we research the philosophical and sociological sources of this theory, and the specifics of some kinds of contemporary criminality that can be pointed as the reason of creating this new kind of criminal system‘s responses as well, from various countries, but especially from Spain, Italy and Brazil. This theory summarizes the ideas and the guidelines that lay behind all kinds of statutes made in order to fight organized crime and terrorism. As a matter of fact, the criminal law for the enemy theory has being studied and criticized for the last eighteen years in Europe continental criminal law, but until now there isn‘t a clear compatibility between the major part of the researchers‘ thought about it and the statutes made on its logic. In this research we try to understand the philosophic origins and the sociologic content of the criminal law for the enemy theory in order to provide a valid theoretical background to the statutes based on it.
