La vivienda familiar y su derecho de uso

Abstract

[ES] En las crisis matrimoniales la vivienda familiar es uno de los puntos más discutidos en los tribunales debido a la difícil posición en que se encuentran cada uno de los cónyuges. Por ello tenemos que realizar un gran esfuerzo para analizar las diferentes circunstancias que pueden existir. Como no es posible todavía encontrar una definición de vivienda familiar en nuestro Código Civil de manera literal, debemos de atender a las resoluciones dictadas por los tribunales a lo largo de los años. La existencia de hijos hace que varíen los criterios que hay que tener en cuenta para la atribución a los progenitores. Y además la titularidad sobre la vivienda supone un conflicto tanto en la figura del matrimonio como en las parejas de hecho. El cambio de circunstancias espontáneas pero persistentes nos llevan a extinguir este derecho y adaptarlo así a la realidad social existente en dicho momento siempre protegiendo, el interés del menor.

[EN] In marital crises, the family house in one of the most discussed points in the courts due to the difficult position of each spouse. Therefore we have to make a great effort to analyze the different circumstances that may exist. As it is not yet possible to find a definition of family housing in our Civil Code in a literal way, we must comply with the resolutions issued by the courts over the years. The existence of children causes that the criteria that must be taken into account for the attribution to the parents vary. And in addition, ownership of housing implies a conflict both in the figure of marriage and in de facto couples. The change of spontaneous but persistent circumstances leads us to extinguish this right and adapt it to the social reality existing at that time always protecting, the child’s interest.
