Protección del derecho al honor, la intimidad y la propia imagen atendiendo a la distinta condición de las personas: políticos y menores

Abstract

[ES] Derechos fundamentales como el derecho al honor, la intimidad y la propia imagen, así como la libertad de información entran en conflicto a menudo provocando una situación de confusión sobre la prevalencia de los mismos. Las leyes no fijan unos criterios claros para la resolución de este problema siendo necesario acudir a la jurisprudencia y la doctrina sentada por el Tribunal Supremo y el Tribunal Constitucional. Si bien es verdad que debemos partir de una presunción de primacía del derecho a la libertad de información, también han de tenerse en cuenta diferentes criterios: la veracidad, la relevancia social y la proporcionalidad, llevándose a cabo un juicio de ponderación por el Tribunal correspondiente. Estos derechos, además, protegen con mayor intensidad a los menores y se relajan a la hora de proteger a los políticos. Se llevará a cabo un estudio desde la perspectiva internacional y nacional; constitucional, civil y penal y se verá la protección que se da a cada uno de ellos, así como los mecanismos para solventar los posibles daños que se hayan podido ocasionar a las personas a las que las intromisiones han afectado.

[EN] Fundamental rights such as the right to honour, privacy and self-image, as well as freedom of information, often conflict and lead to confusion about the prevalence of these rights. Law do not establish clear standards for resolving this problem, and it is necessary to use the jurisprudence and doctrine established by the Supreme Court and the Constitutional Court. Although it is true that we must start from a presumption of primacy of the right to freedom of information, different approaches must also be taken into account: veracity, social relevance and proportionality, with a weighting trial being carried out by the corresponding Court. These rights, moreover, protect children with greater intensity and relax when it comes to protecting politicians. A study will be carried out from an international and national perspective; constitutional, civil and criminal, and the protection afforded to each of them will be examined, as well as the mechanisms for solving the possible damages that may have been caused to the people who have been affected by the intrusions in those rights.
