Resumen
[ES] El presente trabajo tiene como objetivo analizar las principales modificaciones en materia de información y transparencia introducidas por la Ley 5/2019, de Contratos de Crédito Inmobiliario. En concreto, la información precontractual que ha de ser facilitada por los prestamistas inmobiliarios y los intermediarios de crédito inmobiliario en los contratos de préstamo con garantía hipotecaria, que no debe reducirse a una mera entrega de documentación, sino que tiene como objetivo la comprensión por parte del potencial prestatario de todos los extremos que puedan regir la vida del futuro préstamo. También se centra en la evaluación previa de la solvencia y en la función del Notario, quien adquiere un papel relevante al quedar obligado a asesorar al potencial prestatario en lo relativo al contrato de préstamo hipotecario.
Por último, se analizan los supuestos de cláusulas suelo, IRPH y vencimiento anticipado de acuerdo con la nueva regulación. [EN] The aim of this work is to analyse the main amendings introduced by Regulatory Law on Real Estate Credit Agreement (5/2019). In particular, the pre-contractual information to be given to consumers by lenders offering home loans, that should not be reduced to give mere documentation to the borrower, but the main point is the potential borrower understanding of the conditions in which the contract is based.
It is also focused on the financial solvency of the borrower and the role of the Public Notary, who gains importance and is bound by the Law to act as consultant to the borrower.
Finally, is also analysed the impact of the new Law on the floor clauses, the IRPH clauses and the anticipation of expiration clauses.
