La respuesta regional a la migración venezolana. Un análisis comparativo de las medidas excepcionales de recepción entre Colombia, Argentina y Chile (2015-2019)

Abstract

[ES] El deterioro de la situación política y económica en Venezuela ha llevado a miles de venezolanos a abandonar su país hacia otros países, lo cual constituye el éxodo de población más grande en la historia reciente de la región. Mientras que los Estados empiezan a asimilar su nuevo papel como receptores de migrantes, se observa que las respuestas que han dado en la región no son idénticas. Para ello, el objetivo del trabajo es realizar un análisis comparativo de las normativas jurídicas orientadas a la recepción e integración de la migración venezolana entre 2015 y 2019, en término de regularización y promoción de sus derechos en tres países de la región: Colombia, Argentina y Chile. La hipótesis general es que los instrumentos adoptados para atender a la población venezolana son distintos entre los tres países analizados. Utilizando las leyes, decretos y resoluciones nacionales en cada uno de los países, los resultados muestran, en primer lugar, una gran heterogeneidad tanto en el diseño como en la implementación de normas para la gestión de la migración venezolana en los tres países seleccionados. En segundo lugar, se observa que dicha heterogeneidad se explica por un conjunto de factores explicativos: el posicionamiento político hacia la población migrante en las leyes migratorias, la posición política del presidente de turno hacia el gobierno del presidente Maduro y el perfil sociodemográfico de la migración venezolana en cada país de acogida. En tercer lugar, el trabajo confirma tres características en común en las respuestas jurídicas que han dado los tres países receptores: el modelo ad hoc, la temporalidad y la discrecionalidad, las cuales afectan de manera central a la regularización e integración de ciudadanos venezolanos en el contexto de acogida.

[EN] The worsening political and economic situation in Venezuela has led thousands of Venezuelans to leave their country for other countries, which constitutes the largest exodus in the recent history of the region. While the States begin to assimilate their new role as recipients of migrants, it is observed that the responses given by the receiving countries in the region are not identical. The aim of this paper is to undertake a comparative analysis of the legal regulations oriented to the reception of Venezuelan migration between 2015 and 2019, in terms of regularization and promotion of their rights among three countries in the region: Colombia, Argentina and Chile. The general hypothesis is that the instruments adopted to shelter the Venezuelan population are different among the three analyzed countries. Using the national laws, decrees and resolutions in each of the countries, the results show, firstly, a great heterogeneity both in the design and in the implementation for the management of Venezuelan migration among the three selected countries. Second, it is observed that theheterogeneity is explained by a set of explanatory factors: the political position towards the migrant population in the Migration Laws, the political standpoint of the current president towards the Maduro government and the sociodemographic profile of Venezuelan migration in each host country. Third, the study confirms three characteristics in common in the legal responses given by the three host countries: temporality, discretion and the ad hoc model, by which they centrally affect the regularization and integration of Venezuelan citizens in host societies.
