Responsabilidad civil derivada de una intromisión ilegítima en el derecho al honor: especial referencia al honor de las personas jurídicas

Abstract

[ES] En el presente trabajo nos vamos a centrar en analizar cómo se protege civilmente el derecho al honor de las personas, haciendo una especial referencia al honor de las personas jurídicas. En primer lugar, se explican aspectos generales del derecho fundamental al honor, así como quién puede ser titular del mismo. En segundo lugar, nos centraremos en analizar la responsabilidad civil derivada de las intromisiones ilegítimas en el derecho al honor, haciendo un especial énfasis en el análisis de la Ley Orgánica 1/1982, y en la reparación de los diferentes tipos de daños que pueden producir las vulneraciones en el honor de una persona. Posteriormente trataremos los aspectos procesales, tales como la legitimación y la posibilidad de ejercitar el derecho de rectificación. Por último, trataremos temas ampliamente discutidos por doctrina y jurisprudencia, así como el conflicto que existe entre el derecho al honor y las libertades de expresión e información, y terminando por analizar los problemas que suscitan las intromisiones ilegitimas en el honor de las personas llevadas a cabo a través de Internet.

[EN] In this dissertation we are going to focus on analysing how the right to honour is protected by public liability, making special reference to the legal persons honour. At first, we explain general aspects of the fundamental right to honour, as well as who can be the holder of it. Secondly, we will focus on analysing the public liability derived from illegitimate interferences in the right to honour, with special emphasis on the analysis of Organic Law 1/1982, and the repair of the different types of damages that may be produced violations in the person honour. Later we will address procedural aspects, such as legitimation and the possibility of exercising the right of rectification. Finally, we will address topics discussed by doctrine and jurisprudence, as well as the conflict that exists between the right to honour and the freedoms of expression and information, and ending we analyse the problems caused by illegitimates interferences in the honour carried out the conduct through the Internet.
