La falta de conformidad en la compraventa de bienes de consumo

Abstract

[ES] En un contrato de compraventa celebrado entre un empresario y un consumidor, el Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias se encarga de proteger al consumidor ante una falta de conformidad entre el producto que ha adquirido y lo que establece el contrato. Existen unos requisitos para considerar responsable al vendedor. Si se cumplen, el consumidor tendrá la opción de elegir uno de los cuatro remedios que la ley le ofrece: la reparación o sustitución del bien, la rebaja del precio o la resolución del contrato. Es necesario que se cumplan los plazos establecidos para que el comprador pueda ejercer su derecho. Este es un concepto más amplio que el de vicios ocultos, el cual se encuentra recogido en el Código Civil desde el principio.
