Protección de los Derechos Fundamentales en Europa: Jurisdicciones de Estrasburgo y Luxemburgo

Abstract

[ES] El siguiente trabajo tiene por objeto examinar la relación existente entre el Tribunal Europeo de Derechos Humanos, conocido como Tribunal de Estrasburgo, por tener allí su sede, en el seno del Consejo de Europa, con el Tribunal de Justicia de la Unión Europea, también llamado Tribunal de Luxemburgo, pues en dicha ciudad se encuentra este. El mecanismo utilizado por ambos tribunales para colaborar entre sí ha sido el diálogo judicial. Además, se realizará un análisis de ambas instituciones, tanto de su estructura como funcionamiento, así como de los principales instrumentos de ambas organizaciones dirigidos a la protección de los derechos fundamentales, el Convenio Europeo de Derechos Humanos y la Carta de los Derechos Fundamentales de la Unión Europea, respectivamente. El estudio se centrará sobre la posible adhesión o no de la UE al CEDH, tomando como punto de partida el Tratado de Lisboa, examinando el antes y el después del mismo, así como las potenciales consecuencias negativas del Dictamen 2/13 emitido por el TJUE, el cual muestra una postura que hace inviable la adhesión por parte de la Unión Europea al CEDH.

[EN] The following work aims to examine the relationship between the European Court of Human Rights, known as the Strasbourg Court, having its seat there, within the Council of Europe, with the Court of Justice of the European Union, also known as the Court of Luxembourg, since it is in that city. The mechanism used by both courts to collaborate with each other has been judicial dialogue. In addition, an analysis will be made of both institutions, both in terms of their structure and functioning, as well as of the main instruments of both organizations aimed at the protection of fundamental rights, the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union, respectively. The study will focus on whether or not the EU will join the ECHR, taking as its starting point the Treaty of Lisbon, examining the before and after it, as well as the potential negative consequences of Opinion 2/13 issued by the ECJ, which displays a position which makes it impossible for the European Union to accede to the ECHR.
