La propiedad intelectual en el ámbito de los TFGs

Abstract

[ES] La propiedad intelectual pretende la protección de las creaciones originales, ya sean éstas literarias, artísticas o científicas, expresadas por cualquier medio o soporte, tangible o intangible, actualmente conocido o que se invente en el futuro. En el ámbito universitario surgen muchas de estas creaciones intelectuales. El TFG entendido como una asignatura obligatoria que conforma el plan de estudios de Grado de las Universidades españolas es considerado, por ende, una creación protegible. Con este trabajo, que elaboran bajo la orientación de un tutor/a, los estudiantes universitarios reciben la oportunidad de convertirse en autores, en cuyo caso, asumen la titularidad de una serie de derechos de carácter patrimonial y moral sobre su obra que están reconocidos en la ley. Esta clase de trabajos académicos se nutren de otros anteriores mediante las citas bibliográficas, las cuales deben realizarse adecuadamente, de tal forma que no se constituya infracción alguna de los derechos de autor. De igual forma, en torno al TFG orbitan también otras cuestiones conflictivas relacionadas con la propiedad intelectual como son el plagio académico o el

[EN] Intellectual property protects original creations, whether literary, artistic or scientific, expressed by any means or medium, tangible or intangible, currently known or that will be developed in the near future. At University area many of these intellectual creations arise. The Final Work Paper, understood as a obligatory subject which is an integral part of the degree program of the Spanish Universities, is considered, therefore, as a protectable creation. With this project, which is performed under tutor guidance, university students are given the chance to become authors, in such a way as to assume ownership of a series of patrimonial and moral rights about their work that are recognized in the law. This type of academic projects are nourished by previous ones through bibliographic citations, which should be written propperly, in such a way as to not make copyright infringement. Likewise, other conflicting issues related to intellectual property such as the academic plagiarism or the deposit of these projects in the Univeristy institutional repositories.
