El proceso penal de menores

Abstract

[ES] El presente trabajo va enfocado a conocer y valorar los cambios y mejoras que se han ido produciendo a lo largo de los años dentro del ámbito del proceso penal de menores: desde un pensamiento totalmente punitivo para responder ante aquellos actos tipificados como delito que se llevan a cabo por menores, a cambiar esa visión buscando soluciones orientadas a fines educativos y resocializadores con una regulación específica donde el procedimiento, sanciones, fines y objetivos están inspirados en dar una solución menos represiva a ese menor infractor. Bajo mi punto de vista, el tema a tratar (llevando a cabo un análisis del proceso penal de menores como tal) debido a su importancia no es un tema baladí, ya que esto nos permite mejorar y avanzar a nivel humanitario y en el ámbito de la justicia, lo cual en ocasiones no es muy aceptado por la sociedad debido a que estas soluciones se entienden como una respuesta débil del sistema ante aquellos que delinquen, sin tener en cuenta que hablamos de menores, los cuales muchos están en disposición plena para poder reintegrarse por completo en la sociedad, y como Estado debemos proporcionarles esa oportunidad de tener una vida digna con todo lo que eso significa en un futuro. De ahí que el objeto de este trabajo sea el proceso penal de menores (regulado en nuestra LO 5/2000) y dentro de ella, otorgándole especial importancia a la mediación como alternativa para conseguir estos fines.

[EN] The present work is focused on knowing and assessing the changes and improvements that have been taking place over the years within the field of juvenile criminal proceedings: from a totally punitive thinking to respond to those acts classified as crimes carried out by minors, to change that vision by seeking solutions oriented to educational and re-socializing purposes with the regulation of special laws where the procedure, sanctions, aims and objectives are inspired to give a less repressive solution to that minor offender. In my view, the issue to be addressed due to its importance is not a trivial one, since this allows us to improve and advance at a humanitarian level and in the field of justice, which sometimes is not very accepted by society because these solutions are understood as a weak response of the justice system to those who offend without taking into account that we are talking about minors, many of whom are in full capacity to be able to fully reintegrate into society and as a State we must provide them with that opportunity to have a dignified life with all that that means in the future. That is why the object of this work is the penal process of minors (regulated in our LO 5/2000) and within it we are giving special importance to mediation as an alternative to achieve these ends.
