Viajes vinculados de turismo

Abstract

[ES] La nueva Directiva (UE) 2015/2302 del Parlamento Europeo y del Consejo de 25 de noviembre de 2015, relativa a los viajes combinados y a los servicios de viajes vinculados (a partir de ahora, DVCSVV), además de la figura tradicional de los viajes combinados, ha visto necesario introducir una nueva modalidad de contratación de servicios turísticos, los viajes vinculados de turismo. En el nacimiento de esta nueva modalidad de confeccionar un viaje ha influenciado el auge de Internet y la posición activa que ha pasado a ocupar el nuevo denominado viajero. Esta nueva forma de contratación supone una novedad que hasta el momento venía generando incertidumbre en el mercado turístico, así como cierta inseguridad jurídica. Este trabajo expone de manera detallada cada una de las características de los nuevos viajes vinculados de turismo, en función de su introducción en la normativa comunitaria respecto a los servicios turísticos y la manera en que debe llevarse a cabo su contratación, las partes que intervienen, destacando la introducción de la nueva figura del viajero, y finalmente contemplando el régimen de responsabilidad derivada de la ejecución de esta nueva realidad.

[EN] The new Directive (UE) 2015/2302 of the European Parliament and the Council, 25 November 2015, on package travel and linked travel arrangement, has seen the need of introducing the new form of contracting tourist services, known as linked travel arrangement. The birth of this new way of compose a trip has been influenced by the rise of Internet and the active position that the new entitled traveler has occupied. This new way of contracting a trip entails a novelty that up to now had been generating uncertainty in the tourist market, as some legal insecurity. This assignment expounds in detail each of the characteristics of these new linked travel arrangements, based on its inclusion in the Community normative in respect to the tourist services and the way in which its contracting must be performed, the parties that intervene, emphasizing the introduction of new figure of the traveler, and finally, studying the liability regime derived from the execution of this new reality.
