Resumen
[ES] El Impuesto sobre el Incremento de Valor de los Terrenos de Naturaleza Urbana (IIVTNU), conocido como la “plusvalía municipal” es un impuesto local potestativo, y por lo tanto constituye una posible fuente de financiación de los ayuntamientos para llevar a cabo sus políticas y prestar los servicios sobre los que tienen atribuida competencia. La configuración normativa del impuesto lleva desde la crisis económica e inmobiliaria del año 2008 en el punto de mira del Tribunal Constitucional y del Tribunal Supremo, debido a las dudas acerca de su adaptación a los principios constitucionales de capacidad económica y no confiscatoriedad recogidos en el artículo 31 de la Constitución Española. Han sido numerosos los pronunciamientos del Tribunal Constitucional y de los tribunales ordinarios acerca de la regulación del IIVTNU en el Texto Refundido de la Ley Reguladora de las Haciendas Locales.
El objetivo del trabajo es analizar el régimen jurídico actual del impuesto, localizar los principales problemas de su regulación y aplicación, así como el estudio y análisis de las principales Sentencias del Tribunal Constitucional y Tribunal Supremo. [EN] The Local Tax on Property Sales (IIVTNU, in Spanish), known in Spanish as “plusvalía municipal” is a local optional tax, and consequently constitutes a possible source of financing for the district to execute their policies and provide the services over which they have attributed competence. The legal configuration of the tax has been in the sights of the Constitutional Court and the Supreme Court since the economic and real estate crisis of the year 2008, due to doubts about its adequacy to the constitutional principles of economic capacity and non-confiscatory nature included in the article 31 of the Spanish Constitution. There have been numerous judgments by the Constitutional Court and the ordinary courts relating to the regulation of the IIVTNU in the Restated Text of the Regulatory Act of Local Treasuries. The aim of the project is to analyse the current legal regime of the tax, look for the main problems of its regulation and application, as well as the study and analysis of the main Judgments of the Constitutional Court and Supreme Court.
