El régimen jurídico de los aprovechamientos energéticos en el dominio público

Abstract

[ES] Actualmente, el concepto de “aprovechamiento energético” sigue teniendo una escasa relevancia por parte de los ciudadanos, mientras que por parte del Estado en su conjunto y de Europa es de tal importancia que, desde hace más de 20 años, lleva elaborando una regulación un tanto extensa de apoyo al fomento de energías renovables. Por ello, en el presente trabajo se desglosará esa regulación y no solo a nivel estatal, sino con las leyes autonómicas que puedan tener algunas regiones en este ámbito. Y resaltando el régimen específico existente en el sector eléctrico. Y, por último, se hará hincapié en el nuevo Real Decreto Ley de 23 de junio, con sus medidas de emergencia por causas del estado de alarma de este año 2020.

[EN] Nowadays, the concept of “energetic uses” is still a non important issue for most citizens but, for the goverment itself and for Europe is truly important. It is of such importance that they have been elaborating a large regulation to promote the use of renewable energies, for more tan 20 years. That is the reason why, in this work we are going to study each parto f this regulation, both state regulation and regional regulation that could directly influence in this matter. And highlighting the specific regime about electric energy and its sector. Finally, we will go deep inside the Royal Decree Law from June the 23th, treating the emergency measures caused by the alarm state in this year 2020.
