La mejora del procedimiento administrativo de exportación e importación de bienes culturales

Abstract

[ES] Con la creciente evolución de la era de la globalización, el Derecho administrativo camina hacia la armonización entre la legislación administrativa de la Unión Europea y la normativa de los Estados miembro, lo que se conoce como la “europeización del Derecho administrativo”. Asimismo, el aumento del comercio exterior y la búsqueda de un mercado único traen consigo el incremento de exportaciones e importaciones de distintos bienes; en este caso me centraré en el estudio de los bienes culturales, que –en el afán proteccionista de los distintos Estados y de la propia Unión Europea– va a traer consigo diversos conflictos de intereses o derechos. En este trabajo, haré un análisis de la normativa española y europea en materia de exportación e importación de bienes culturales, así como la problemática que de ella deriva, y trataré de ofrecer mejoras en estos procedimientos administrativos que – desde mi punto de vista– pudieren dar solución a esta.

[EN] With the increasing evolution of the era of globalisation, administrative law is moving towards harmonisation between the administrative legislation of the European Union and the regulations of the Member States, which is known as the "Europeanisation of administrative law". Furthermore, the increase in foreign trade and the search for a single market are leading to an increase in exports and imports of different property; in this case I will focus on the study of cultural property, which - in the protectionist spirit of the different States and of the European Union itself - is going to lead to various conflicts of interest or rights. In this work, I will analyse the Spanish and European regulations on the export and import of cultural property, as well as the problems arising from them, and I will try to offer improvements in these administrative procedures which - in my view - could provide a solution to this.
