dc.description.abstract | [ES] La repentina presión migratoria a la que se ha visto expuesta la Unión Europea desde 2015 ha constituido uno de los múltiples factores para reformular el mandato y los poderes de la Agencia Europea de la Guardia de Fronteras y Costas (FRONTEX) por cuarta vez. El nuevo Reglamento (UE) 2019/1896 sobre la Guardia Europea de Fronteras y Costas recoge la normativa a propósito del ámbito competencial de la Agencia, así como el fortalecimiento de las actividades operativas del cuerpo permanente de FRONTEX en el terreno de los Estados miembros del sur del Mediterráneo. Entre sus principales innovaciones destacan la creación de un cuerpo permanente de 10.000 efectivos para el año 2027, una mayor financiación, la facultad de la Agencia para intervenir en Estados terceros, el desarrollo de poderes ejecutivos y coercitivos por parte del personal estatutario o el refuerzo de sus competencias operativas en materia de retorno. Con el objetivo de ofrecer una respuesta efectiva a esta grave crisis que todavía sigue latente en el continente europeo, las instituciones de la Unión todavía permanecen lejos de centralizar la administración de sus fronteras externas, ya que la gestión de las mismas sigue estando, en última instancia, en manos de la soberanía nacional de los Estados miembros. En este sentido, las limitaciones que presentan las actuaciones de la Agencia para hacer frente a la llegada masiva de nacionales de terceros Estados siguen focalizándose en supervisar la gestión fronteriza y asistir a las autoridades nacionales sujetas a este tipo de oleadas migratorias. La entrada en vigor de este Reglamento refleja un intento de comunitarización de las políticas de inmigración y de asilo de la Unión Europea, a pesar de que los Estados continúan mostrando reticencias a la hora de ceder su soberanía en este ámbito material. | es_ES |
dc.description.abstract | [EN] The sudden migratory pressure to which the European Union has experienced since 2015 has been one of the many factors in reforming the mandate and powers of the European Border and Coast Guard Agency (FRONTEX) for the fourth time. The new regulation (EU) 2019/1896 on the European Border and Coast Guard takes over both the regulation concerning the Agency’s field of competence and the strengthening of the operational activities of FRONTEX’s permanent body on the Mediterranean States Members’ territories. Among its main innovations are the creation of a 10,000 strong permanent corps by 2027, increased funding, the Agency’s ability to intervene in third states, the development of executive and coercive powers of the statutory staff and the strengthening of its operational powers in the field of return. With the aim of providing an effective response to this crisis that is still latent on the European continent, the EU’s institutions are still far from centralizing the administration of its external borders. In fact, its management is still a matter of the member states national sovereignty. In this regard, the limitations of the Agency’s actions in dealing the mass influx of third country nationals continue to focus on supervising the border management and assisting the national authorities’ subjects to this type of migratory waves. The entry into force of this regulation reflects an intent to communitise the European Union’s Immigration and asylum policies, despite the fact the States continue to be reluctant to surrender their sovereignty in this material area. | en_EN |
