Prevención y represión del blanqueo de capitales: órganos implicados e investigación del delito

Abstract

[ES] El objeto de este trabajo es analizar el delito de blanqueo de capitales y algunos de los medios con los que cuenta España para su persecución y enjuiciamiento. Para ello, he dedicado el primer punto del trabajo al propio delito, explicando primeramente en qué consiste, las fases de las que consta, algunas de las técnicas utilizadas habitualmente para llevarlo a cabo, su evolución normativa y los medios tanto preventivos como represivos con los que cuenta España en su lucha contra este delito. Posteriormente, he pasado a examinar a dos de los órganos con mayor relevancia en la lucha contra el blanqueo de capitales en España, desde el punto de vista preventivo y represivo, como son la Comisión para la Prevención del Blanqueo de Capitales e Infracciones Monetarias y la Policía Judicial, en particular la Unidad de Delincuencia Económica y Fiscal del Cuerpo Nacional de Policía. Finalmente, he realizado un pequeño análisis sobre la investigación de este delito por parte de los cuerpos policiales, haciendo una especial referencia a la investigación llevada a cabo por la policía judicial, exponiendo algunas de las técnicas de investigación utilizadas, así como el inicio de la misma por parte de la policía y terminando con algunas de las ventajas y desventajas de que el peso de la investigación esté en manos de los cuerpos policiales.

[EN] The aim of this study is to analyse the crime of money laundering and some of the means available in Spain for its prosecution and trial. In order to do it, I have dedicated the first point of the project related to the crime itself, explaining first of all what it consists of, the phases involved, some of the techniques usually used to carry it out, its regulatory evolution and the means both preventive and repressive that Spain has at its disposal in its fight against this crime. Then I have examined two of the most important bodies in the fight against money laundering in Spain, from the preventive and repressive point of view, namely the Commission for the Prevention of Money Laundering and Monetary Offences and the Judicial Police, in particular the Economic and Fiscal Crime Unit of the National Police Force. Finally, I have made a brief analysis of the investigation of this crime by the police forces, making special reference to the investigation carried out by the judicial police, setting out some of the investigation techniques used, as well as the initiation of the investigation by the police and ending with some of the advantages and disadvantages of the weight of the investigation being in the hands of the police forces.
