Aproximación al estudio del matrimonio temporal islámico (mutʿa): consideraciones doctrinales, desarrollo histórico e interpretación moderna

Abstract

[ES]En este trabajo se ha realizado una aproximación histórica y actual de los matrimonios de placer (mut' a). Empezando con la interpretación y definición histórica de , dentro del marco pre y post profético, seguido de ciertas consideraciones previas acerca del matrimonio; después se ha considerado importante destacar las diferencias que albergan los matrimonios permanentes y los matrimonios temporales. A continuación, se ha procedido a describir los diferentes tipos de matrimonios temporales (mi y ), realizando un breve estudio de ambas prácticas para dar paso a la situación y características del matrimonio en la actualidad. También, en correlación al tema tratado en este trabajo, se han recogido aspectos legales presentes en diferentes códigos de estatutos personales de países árabes y no árabes; con el objetivo de demostrar el vacío legal del que se aprovecha este tipo de uniones temporales. Finalmente, se ha recogido exhaustivamente de diferentes materiales (audiovisuales, prensa, documentales, informativos, debates…) una variedad de opiniones para destacarlas características prácticas de los matrimonios temporales. Cabe añadir, que este trabajo aborda temas y prácticas de diferentes ramas islámicas, resaltando el š , y abarca un tema de naturaleza religiosa, pero a la vez social, aún vigente en la sociedad islámica

[EN]In this work a historical and current approximation of marriages of pleasure (mutʿa) has been made. Beginning with the historical interpretation and definition of mutuality, within the pre and post prophetic and framework, followed by certain previous considerations about marriage because it was considered important to highlight the differences between permanent and temporary marriages. Then, it has proceeded to describe different types of temporary marriages (misyār and ʿurfi) making a brief study of both practices until nowadays. Also, in correlation to the topic dealt with in this work, legal aspects present in different codes of personal statutes of Arab and non-Arab countries have been collected with the aim of demonstrating the legal vacuum that this type of temporary unions take advantage of. Finally, a variety of opinions have been collected exhaustively from different materials (audiovisual, press, documentary, informative, debates ...) to highlight the practical characteristics of temporary marriages. It should be added that this work addresses topics and practices of different Islamic branches, highlighting Shi'ism, and covers a theme of a religious but at the same time social nature which is still in force in Islamic society
