Resumen
[ES] Para revelar el origen de la acción humana, una de las ideas esenciales es el concepto de autodeterminación del individuo, por lo que es necesario tomar en consideración el indeterminismo o, lo que es lo mismo, la facultad de decisión y el libre albedrío del ser humano y su relación con el posible determinismo existente en la comisión de hechos delictivos. A lo largo de la historia se han generado diversas corrientes integradas en alguna de estas ideas y que fundamentan la responsabilidad penal de los sujetos en la causalidad por un lado y, por otro lado, en función de la corriente seguida, en la aptitud de la persona para decidir no llevar a cabo la comisión de hechos delictivos en el caso del indeterminismo o, en la aparente peligrosidad del sujeto en el caso del determinismo.
Diversos estudios realizados en el ámbito de las ciencias naturales ponen de manifiesto la existencia de factores biológicos, psíquicos y conductuales que, en sí mismos, pueden ser la causa de un comportamiento antisocial o incluso criminal. Se profundizará en la importancia del papel que juegan estos elementos en el comportamiento humano y en la posibilidad de que este comportamiento resultante sea o no irrefrenable para el sujeto. [EN] To reveal the origin of human action, one of the essential ideas is the concept of self-determination of the individual, so it is necessary to take into consideration indeterminism or, what is the same, the power of decision and the free will of humans and its relationship with the possible determinism that exists in the commission of criminal acts. Throughout history, different currents have been generated and integrated into some of these ideas and they base the criminal responsibility of the subjects on causality on the one hand and, on the other hand, depending on the current followed, on the aptitude of the person to decide not to carry out the commission of criminal acts in the case of indeterminism or, in the apparent dangerousness of the subject in the case of determinism.
Various studies carried out in the field of natural sciences reveal the existence of biological, psychic and behavioral factors that, in themselves, can be the cause of antisocial or even criminal behavior. The importance of the role that these elements play in human behavior and the possibility that this resulting behavior may or may not be irrepressible for the subject will be studied in depth.
