El delito del tráfico de drogas. Tratamiento y evolución

Abstract

[ES] El delito del tráfico de drogas se configura como un delito de peligro cuya tipificación nace de la necesidad de proteger la salud pública debido a su expansión y al impacto de los efectos de las drogas. Tanto los organismos internacionales como los diversos Estados han tratado de dar respuesta a lo largo de los años, optando siempre por emplear el Derecho Penal como respuesta, aplicando políticas prohibicionistas que buscan la represión y el castigo de los comportamientos relacionados con el tráfico de drogas. Sin embargo, no se debe ignorar que la relación del ser humano con las drogas se remonta a sus mismos inicios de modo que para poder entender la dimensión del fenómeno de las drogas es necesario conocer la evolución legislativa de su tratamiento. Es por esto que a lo largo de este trabajo se va a tratar de dar un enfoque lo mas amplio posible al problema, tratando los siguientes aspectos: qué son las drogas, cual es el bien jurídico protegido tanto desde la perspectiva internacional como desde la jurisprudencia del Tribunal Supremo, la evolución del problema a lo largo de la historia, la regulación internacional y la regulación en España en concreto de la respuesta al tráfico de drogas, así como la política prohibicionista adoptada y las posibles alternativas que existen al tratamiento del problema.

[EN] The crime of drug trafficking is configured as a crime of danger whose classification arises from the need to protect public health due to its expansion and the impact of the effects of drugs. Both international organizations and the various States have tried to respond over the years, always choosing to use Criminal Law as a response, applying prohibitionist policies that seek the repression and punishment of behaviors related to drug trafficking. However, it should not be ignored that the human being's relationship with drugs dates back to its very beginnings, so that in order to understand the dimension of the drug phenomenon, it is necessary to know the legislative evolution of its treatment. That is why throughout this work we will try to give the widest possible approach to the problem, dealing with the following aspects: what are drugs, what is the protected legal asset both from the international perspective and from the jurisprudence of the Supreme Court, the evolution of the problem throughout history, international regulation, and regulation in Spain in particular of the response to drug trafficking, as well as the prohibitionist policy adopted and the possible alternatives that exist to treat the problem.
