Abstract

[ES] El presente trabajo consiste en un estudio del fenómeno de los juicios paralelos en asuntos relativos al ámbito penal, cuyas dimensiones se han visto acentuadas por la presencia de las redes sociales en nuestras vidas, con el objetivo de comprender en qué consiste y los peligros que entraña. Para ello se analizará el principio de publicidad de las actuaciones judiciales y los juicios paralelos propiamente dichos, prestando atención a garantías constitucionales y derechos fundamentales que se pueden ver afectados, así como al peligro que suponen para la confianza de la ciudadanía en el Poder Judicial. También se realizará un análisis de los juicios paralelos más destacables en nuestro país de los últimos años. Finalmente, se expondrá la importancia de lograr un equilibrio entre la información proporcionada por los medios de comunicación y el respeto a los principios y derechos y los posibles mecanismos para alcanzarlo.

[EN] This work consists of a study of the phenomenon of parallel trials in criminal matters, whose dimensions have been accentuated by the presence of social networks in our lives, with the aim of understanding what it consists of and the dangers it entails. To this end, the principle of publicity of judicial proceedings and parallel trials themselves will be analyzed, paying attention to constitutional guarantees and fundamental rights that may be affected, as well as the danger they pose to the confidence of citizens in the Judiciary. An analysis will also be made of the most notable parallel trials in our country in recent years. Finally, the importance of achieving a balance between the information provided by the media and respect for the principles and rights and the possible mechanisms to achieve it will be presented.
