Uso de sistemas de armas autónomas letales en relación con el derecho internacional

Abstract

[ES] A lo largo de la historia se ha demostrado que una de las cosas que se le da bien al ser humano es la guerra, la cual ha ido evolucionado constantemente hacia nuevas formas de llevar acabo esta. Este trabajo versa sobre una de ella, como son los Sistemas de Armas Autónomas Letales (SAAL), plantean una revolución en los conflictos armados pues supondría que estas armas serían las que librarían los combates e incluso sin la necesidad de estar controladas por el ser humano. Por lo que a través del análisis, que llevare acabo durante este trabajo, pretendo analizar las cuestiones más problemáticas que rodean estas nuevas armas en el ámbito internacional. Partiendo de dificultad que entraña el lograr una definición unánime de estos sistemas, prosiguiendo con otro de los grandes obstáculos que nos encontramos en esta materia como es la determinación de la responsabilidad por el uso de estás. Para finalizar con un examen de la normativa básica que rodea estas máquinas y un breve vistazo a la forma de lograr la tan necesaria regulación especifica sobre estas armas.

[EN] Throughout history, it has been demonstrated that one of the things that humans are good at is warfare, which has constantly evolved towards new ways of carrying it out. This study deals with one of them, such as Autonomous Lethal Weapon Systems (LAWS), which would bring about a revolution in armed conflicts as it would mean that these weapons would be the ones that would fight the battles and even without the need to be controlled by human beings. Therefore, through the analysis that I will carry out in this paper, I intend to analyze the most problematic issues surrounding these new weapons in the international arena. Starting with the difficulty of achieving a unanimous definition of these systems, and continuing with another of the major obstacles we face in this area, namely the determination of responsibility for the use of these weapons. It ends with an examination of the basic regulations surrounding these machines and a brief look at how to achieve the much-needed specific regulation of these weapons.
